The food safety lawyers at OFT Law filed the first lawsuit against Boar’s Head arising from the multistate Listeria outbreak linked to deli meat. The lawsuit against Boar’s Head alleges that the company allowed Listeria to contaminate its liverwurst and this contamination spread to deli environments and other deli meats at retail delis across the country, particularly in New York and Maryland.

Details of the Listeria Contamination

According the Complaint, the Plaintiff purchased Boar’s Head liverwurst from a St. Louis area deli, and later fell deathly ill. The Plaintiff was transported by ambulance to a nearby hospital where she stayed for ten days before going to a rehabilitation facility.

Boar’s Head Responsibility in Preventing Listeria Contamination

According to OFT lawyer Brendan Flaherty the case illustrates why companies like Boar’s Head should never allow Listeria contamination of their products or facilities. “Listeria should always be a deli meat company’s number one concern,” Flaherty said. “Listeria is the most dangerous foodborne pathogen and tends to thrive in meat processing facilities.”

The lawsuit alleges that Boar’s Head should have prevented the contamination and outbreak through better sanitation, hygiene and pathogen testing programs.  “Cases like this one force industry to clean up their processing facilities and refocus on food safety and prevention of Listeria contamination.”
