OFT Law PLLC, alongside Nicolet Law Office, S.C., has filed a federal lawsuit against Chipotle Mexican Grill, Inc. on behalf of a Minnesota resident who was hospitalized with life-threatening sepsis after contracting Salmonella Javiana from contaminated food served at the Roseville, Minnesota Chipotle. The complaint was filed in the United States District Court for the District of Minnesota (Case No. 26-cv-03514).

DNA Evidence Directly Links Victim’s Illness to Chipotle Outbreak

Unlike cases that rely strictly on circumstantial evidence, DNA sequencing directly ties our client’s life-threatening illness to Chipotle.

According to the complaint:

  • The Incident: On June 22, 2026, our client ate a chicken burrito bowl from the Roseville Chipotle located at 2325 Fairview Avenue North. Her meal contained fresh tomato salsa and roasted chili-corn salsa—both of which feature raw, diced jalapeño peppers as a standard ingredient.

  • Hospitalization & Sepsis: Days later, on June 27, our client fell severely ill and was hospitalized on June 28. The Salmonella infection escaped her intestinal tract and entered her bloodstream, triggering sepsis—a severe, life-threatening bodily response to systemic infection.

  • Genomic Proof: Public health laboratories conducted Whole Genome Sequencing (WGS) on our client’s bacterial isolate. CDC scientists deposited her isolate directly into the National Center for Biotechnology Information (NCBI) Pathogen Detection database and placed it inside SNP cluster PDS000268094—the exact genomic cluster that defines this multistate Salmonella Javiana outbreak.

Outbreak Scope Continues to Expand

Public health officials originally linked at least 110 illnesses in Minnesota and 212 illnesses nationwide to this Salmonella Javiana outbreak. However, analysis of the federal genomic database reveals that SNP cluster PDS000268094 already contains at least 327 clinical isolates—meaning every single sequenced isolate in the cluster was cultured from a sick human patient. Because most foodborne illness cases go unreported to health authorities, the actual number of individuals sickened in this outbreak is likely in the thousands.

n response to the outbreak, Chipotle activated its internal traceability system and confirmed that it traced the contamination to a common lot of fresh jalapeño peppers distributed across its locations.

A Pattern of Food Safety Failures

The complaint notes that this is far from Chipotle’s first struggle with supply chain contamination.

  • 2015 Minnesota Outbreak: Eleven years ago, Chipotle served Salmonella-contaminated fresh tomatoes to Minnesota diners, sickening at least 64 people across 22 locations.

  • 2020 Criminal Fine: In 2020, Chipotle agreed to pay a $25 million criminal fine—the largest food-safety fine in U.S. history—to resolve federal charges that it shipped and served adulterated food that sickened more than 1,100 customers between 2015 and 2018.

Despite public promises to overhaul its supply chain oversight and supplier verification programs, Chipotle once again distributed pathogen-laden produce directly to consumers.

Claims Asserted in the Lawsuit

The legal action asserts multiple counts against Chipotle Mexican Grill, Inc., including:

  1. Strict Product Liability: Chipotle sold a food product that was defective, unreasonably dangerous, and adulterated with a deadly pathogen without any warning.

  2. Negligence: Chipotle failed to properly select, vet, and audit its produce growers, packers, and distributors, and failed to verify pathogen testing documentation before serving raw peppers to customers.

  3. Negligence Per Se: Chipotle violated the Minnesota Food Law (Minn. Stat. § 31.02 et seq.) by manufacturing, delivering, and selling adulterated food within Minnesota.
